Red Cross Raises $11-Million in Sandy Relief Efforts - Prospecting ...

The American Red Cross announced that it has received more than $11-million in donations for its efforts to help the millions of families displaced by Superstorm Sandy.

Among the gifts announced today by donors to the Red Cross National Disaster Fund:

? The New York Yankees have given $500,000 to the charity to support relief efforts in New York, New Jersey, and Connecticut.

??Citi Foundation has given $100,000, on top of the $50,000 it gives annually to the disaster fund.

? CVS Caremark, the pharmacy chain, has given $50,000 in cash from its CVS Caremark Charitable Trust and another $50,000 in food and bottled water, which will be distributed to storm victims in New Jersey.

? United Airlines Foundation has announced it will provide up to $50,000 to match donations made to the Red Cross, Feeding America, or AmeriCares on the Crowdrise fundraising platform. It will also give members of its frequent-flier program bonus miles for contributing to those charities.

New Syria fighting despite UN-backed truce

BEIRUT (AP) ? Syrian warplanes and artillery struck rebellious suburbs east of Damascus, while rebels attacked regime positions elsewhere near the capital Sunday, violence that marred the third day of what was meant to be a four-day holiday truce, activists said.

A U.N-backed truce declared for the Muslim holiday of Eid al-Adha has failed to take hold, with fighting reported from the start. Activists said more than 150 people were killed Friday, the start of the holiday, and more than 120 people on the second day, similar to previous daily casualty tolls.

The cease-fire was seen as a long shot from the outset. The international mediator in Syria, Lakhdar Brahimi, failed to get firm commitments from all combatants.

At least one rebel-linked radical Islamic group, the al-Qaida-inspired Jabhat al-Nusra, rejected the truce outright. In a video posted this week, the leader of al-Qaida, Ayman al-Zawahri, urged "Muslims everywhere" to support Syria's uprising.

The truce was called as the two sides were battling over strategic targets in a largely deadlocked civil war. They include a military base near a main north-south highway, the main supply route to Aleppo, Syria's largest city, where regime forces and rebels have been fighting house-to-house. It appears each side feared the other could exploit a lull to improve its positions.

With the unraveling of the cease-fire, it's unclear what the international community can do next.

The holiday truce marked the first attempt in six months to reduce the bloodshed in Syria, where activists say more than 35,000 people have been killed in 19 months.

Brahimi has not said what would follow a cease-fire. Talks between Syrian President Bashar Assad and the Syrian opposition on a peaceful transition are blocked, since the Syrian leader's opponents say they will not negotiate unless Assad resigns, a step he has refused to take.

The international community has been unable to rally around other options, including tougher U.N. Security Council action, arming the rebels or direct military intervention.

The failure of the truce to take hold "highlighted the impotence of the international community's approach" to the Syria conflict, said Salman Shaikh, director of the Brookings Doha Center, a think tank.

In April, Brahimi's predecessor as Syria mediator, former U.N. chief Kofi Annan, tried to launch a more comprehensive plan ? an open-ended cease-fire to be enforced by hundreds of U.N. monitors, followed by talks on a political transition. Annan's plan failed to gain traction, and after an initial decrease in violence, his proposed cease-fire collapsed.

In fighting Sunday, Syrian warplanes struck the eastern Damascus suburbs of Arbeen, Harasta and Zamalka to try to drive out rebels, according to the Britain-based Syrian Observatory for Human Rights, which compiles information from activists in Syria. The Observatory also reported shelling attacks in these areas.

Local activists and another opposition group, the Local Coordination Committees, said warplanes struck Arbeen and Harasta. The LCC said eight people were killed Sunday in Damascus and its suburbs.

Three amateur videos posted online showed warplanes flying over the eastern suburbs.

One video showed two huge clouds of smoke rising from what was said to be Arbeen, and the sound of an airplane could be heard in the background. It was not clear if the video showed the aftermath of shelling or an airstrike.

Another video showed destruction inside the Sheikh Moussa mosque in Harasta. Windows and doors were blown out, glass and debris scattered across the mosque's floor. The narrator broke down as he was heard saying: "Where are the Muslims? Our mosques are being bombed and no one cares."

Also in Harasta, a video showed widespread destruction, including rows of buildings with shattered windows, gaping holes and shell-pocked facades.

The videos appeared consistent with Associated Press reporting in the area.

In Douma, another Damascus suburb, rebels wrested three positions from regime forces, including an unfinished high-rise building that had been used by regime snipers, according to the Observatory and Mohammed Saeed, a local activist.

Fighting was also reported near Maaret al-Numan, a town along the Aleppo-Damascus highway that rebels seized earlier this month. Opposition fighters have also besieged a nearby military base and repeatedly attacked government supply convoys heading there. The Observatory said the Syrian air force fired missiles and dropped barrel bombs ? makeshift weapons made of explosives stuffed into barrels ? on villages near the base.

The Syrian government has accused the rebels of violating the cease-fire from the start. The state-run news agency SANA said opposition fighters carried out attacks in a number of areas, including in Aleppo and the eastern town of Deir el-Zour.

Pa. Health Insurance Exchange Unlikely To Be Ready For Jan. 2014 ...

HARRISBURG, Pa. (AP) ? Pennsylvania?s insurance chief says a state-run health insurance exchange is unlikely to be ready for a scheduled January 2014 implementation.

Insurance Commissioner Michael Consedine said Wednesday that development of the exchange has stalled because too many questions about its cost and other important details remain unanswered by the federal government.

The exchange is part of the federal Affordable Care Act.

A 2011 study estimated at least 2 million Pennsylvanians would use the online exchange to find and buy insurance. But Consedine says it?s going to be extremely difficult to meet a Nov. 16 deadline for a blueprint of the state exchange.

Antoinette Kraus of the nonprofit coalition Pennsylvania Health Access Network says the federal government will operate a Pennsylvania exchange if the state doesn?t act.

The California Department of Corporations and the California Department of Real Estate on Monday, Oct. 15, warned consumers of mortgage loan modification and home refinancing scams.

If anyone tries to collect a fee in advance, beware.

Those practices are illegal, the state agencies said.

?Advance fees for loan modifications have been illegal in California since 2009,? said Corporations Commissioner Jan Lynn Owen. ?Anyone trying to charge a homeowner upfront for such a service is violating the law and should be reported.?

The announcement follows a string of indictments against boilerplate operations that used telephone calls and mass mailings to target homeowners in financial distress.

Other scams being tested now include proposals to sign over your home to a third party to avoid foreclosure and to stop making payments or even default on your mortgage loan as a means to gain negotiating leverage with your bank. Neither of these options will prevent foreclosure and could result in a property owner losing their home even sooner than if the bank were to foreclose, the agencies said.

Before hiring anyone to help modify a loan, consumers should contact the Department of Real Estate at (877) DRE-4LIC or www.dre.ca.gov To file a complaint against a mortgage loan modification consultant, consumers should contact the Attorney General?s Office, Public Inquiry Unit at (800) 952-5225 or visit www.oag.ca.gov

Feds Crack Down on Phony Mortgage Relief Schemes That Falsely ...

The Federal Trade Commission has filed three separate suits in federal court to halt the allegedly deceptive tactics of three operations that preyed on distressed homeowners by falsely claiming they could save their homes from foreclosure, and then charging them thousands of dollars up-front, while delivering little or no help and often driving them deeper into debt.

?With many homeowners still struggling to hold onto their homes, the FTC takes a hard line against con artists who are seeking their next victim,? said Jon Leibowitz, Chairman of the Federal Trade Commission.

Leibowitz appeared with U.S. Attorney General Eric Holder, FBI Associate Deputy Director Kevin Perkins, and HUD Secretary Shaun Donovan, and announced the FTC cases as part of the Distressed Homeowner Initiative, a federal effort to stop predatory foreclosure rescue, mortgage modification, short sales, and bankruptcy schemes that target distressed homeowners.

Since 2008, the FTC has brought more than 40 cases against companies peddling fraudulent mortgage relief schemes, that caused hundreds of millions of dollars in consumer injury.? These law enforcement actions have helped tens of thousands of consumers who were victims of these scams, and have prevented tens of thousands more from becoming victims.

In November 2010, the FTC issued the Mortgage Assistance Relief Services (MARS) Rule, which provided new protections and banned mortgage foreclosure rescue and loan modification services from collecting fees until homeowners have a written offer from their lender or servicer that they deem acceptable.

In all three cases announced today, the FTC took action against defendants who allegedly peddled bogus mortgage relief services, in violation of the FTC Act and the MARS Rule.? The agency also charged that two of the operations violated the Telemarketing Sales Rule.

Prime Legal Plans/Reaching U Network.? The FTC alleged that from at least mid-2010, the defendants behind this scheme marketed mortgage relief services in English and Spanish, including under the names ?Reaching U Network,? and ?American Legal Plans.? ?They allegedly told consumers who were in debt that attorneys would review their mortgage loan documents to see if their lenders complied with state and federal mortgage laws, and would use the resulting ?forensic audit? information to help save their homes and negotiate more favorable mortgage terms.? The defendants told consumers that ?80 percent of mortgages contain some fraud,? and ?Our network attorneys have helped hundreds of Americans stay in their homes,? according to the FTC complaint.

But instead of helping consumers, the defendants charged them up to $750 a month, while little or nothing was done to save their homes from foreclosure, and running an operation that a court found was ?permeated with illegal practices? , according to the FTC.

The FTC alleged that on company websites, the defendants would falsely claim to be a ?private charity working for struggling consumers that can?t afford legal representation.?? When responding to consumers who called the toll-free number on the websites, and when cold-calling consumers, including those listed on the Do Not Call registry, the defendants routinely failed to provide the disclosures required by the MARS Rule, collected up-front fees, and misrepresented the results that consumers could expect, according to the complaint.
The FTC charged that the defendants violated the Telemarketing Sales Rule, the FTC Act, and the MARS Rule by: ?calling consumers whose numbers were listed on the Do Not Call Registry; not paying the required annual fee to access the Registry; misrepresenting that they would get mortgage modifications to make consumers? payments significantly more affordable and help prevent foreclosure, and that they would use so-called forensic audits to do this; ?misrepresenting the amount of time it would take to get results; failing to provide required disclosures about mortgage modification relief; and collecting advance fees.

A federal judge granted the FTC?s request for a temporary restraining order and ordered a freeze of the defendants? assets and the appointment of a receiver.? The preliminary injunction hearing is scheduled for October 11, 2012.

American Mortgage Consulting Group. ?The FTC alleged that since early 2011, the defendants claimed a phony affiliation with the U.S. government, pretended to be attorneys, and promised to substantially lower monthly mortgage payments in exchange for an up-front fee ranging from $1,495 to $4,495.? Along with two companies he controls ? American Mortgage Consulting Group, LLC and Home Guardian Management Solutions, LLC ? defendant Mark Nagy Atalla allegedly violated ?nearly every provision of the Mortgage Assistance Relief Services Rule.?

The defendants telemarketed mortgage relief services to consumers nationwide, often stating that they were paid by the federal government to assist homeowners and obtain so-called ?Home Saver? grants from the government to reduce consumers? up-front fees, according to the FTC?s complaint.? They also allegedly proclaimed themselves to be ?a California Professional Legal Team,? sent documents to consumers from their so-called ?Legal Department,? and referred to their operation in e-mails as a ?law office.?

The defendants claimed they were virtually certain they could obtain loan modifications for their clients, and that the clients would receive a full refund if that did not happen, even though they did little or nothing to help consumers and they failed to provide refunds, according to the FTC.

Also, in violation of the MARS Rule, the defendants allegedly told consumers to stop communicating with their lenders, and failed to disclose that:

  • consumers would only have to pay the defendants if they accepted the terms of the mortgage assistance the defendants obtained from their lenders;
  • the defendants are not associated with the government and their services are not approved by the government or the consumer?s lender; and
  • even if a consumer used the defendants? services, the lender may not agree to change the terms of the consumer?s loan.

By their actions, the defendants diverted consumers in danger of losing their homes from pursuing authentic, government-affiliated programs, and duped them into paying thousands of dollars based on false promises and misrepresentations, according to the complaint.

A federal judge granted the FTC?s request for a temporary restraining order and preliminary injunction, froze the defendants? assets, and appointed a receiver.

Expense Management America. ?Presenting themselves as the solution to all the consumer?s financial problems, the defendants have cold-called thousands of U.S. consumers from their call center in Montreal since at least mid-2010, including those whose numbers were registered on the Do Not Call Registry, according to the FTC complaint.

Whether the consumer was struggling with a mortgage, credit card debt, student loans, car payments, or a poor credit score, the defendants charged an up-front fee of $2,200 to $10,000 that they claimed was being used to pay off debts, according to the complaint. ?The defendants allegedly claimed that their relationships with lenders and their ability to negotiate on behalf of large groups of consumers made it possible to substantially reduce their payments. ?But according to the FTC, the defendants failed to produce any of the promised results.

The defendants ? Expense Management America, six affiliated companies, and five individuals, who operated in Canada and the United States ? also used a series of websites that lured consumers to call them, according to the complaint. ?After pitching consumers by phone, the defendants allegedly would send brochures and financial documents to consumers via e-mail, and obtain their authorization to withdraw funds from their checking accounts. ?One brochure, the Expense Management Guide, explicitly told consumers they must follow the ?Golden Rule,? which was to cease communicating with their creditors and let the defendants do the talking:

?Sometimes [creditors will] go to extremes in an attempt to force you into an agreement by saying things such as ?We?ve never heard of E.M.A.?? Or ?We don?t deal with them.? ? Sometimes [creditors] even break the law. ?Don?t be fooled by them. ?Let E.M.A. do the talking!?
The FTC charged that the defendants violated the Telemarketing Sales Rule, the FTC Act, and the MARS Rule by: ?falsely claiming they could secure more affordable payments and reduce the principal on consumers? loans; making deceptive claims about the price and material aspects of debt relief and other goods and services; charging advance fees for debt relief; calling consumers whose phone numbers are listed on the Do Not Call Registry; telling consumers not to communicate with their lenders; and failing to make the disclosures required by the MARS Rule.

Interestingly, of all the BMI calculators we sampled, every one of them included information on how to lose weight. None of them recognized that some people might in fact be looking to gain weight. Perhaps this is because underweight people are an increasing minority. The number of Americans who are underweight is the lowest it?s been since 1988: Approximately two percent of adult women and one percent of adult men fell into the category of ?underweight? between 2007 and 2010.

Whatever the reason for thinness, people sometimes invalidate the health concerns of those who need to gain weight. There?s a stereotype that nobody can be naturally underweight, says Greatist Expert and trainer Jen Cassetty, so, naturally thin people often face some kind of discrimination. Yet underweight people (particularly men) are just as much at risk for health concerns as overweight and obese people[][]. Being significantly underweight is associated with negative health effects that include lack of energy, nutritional deficiencies, a weakened immune system, osteoporosis, and, in women, loss of menstrual function and complications with pregnancy[][]. So Greatist decided to shine a light on this oft-overlooked version of weight maintenance.

The Beef on Beefing Up ? Your Action Plan

As with any diet or exercise plan, it?s important to consult a physician or nutritionist before adopting any weight gain diet. A doctor can also help rule out other health issues that might be contributing to being underweight, such as thyroid problems, parasites, or disordered eating. After chatting with a doc, follow these guidelines to healthfully pack on some pounds.

  • Keep a food diary. Chart what and when you eat every day for several weeks to learn about your eating habits and identify places to add calories. Online programs like MyFitnessPal and Fitday can make tracking easy-peasy. (They?re also good tools for keeping track of your actual weight.)
  • Add it up. Try adding an extra 200+ calories a day in the beginning, says Cassetty, and adjust up or down depending on results.
  • Focus on quality, not quantity. Even when you?re trying to gain weight, burgers, chips, and milkshakes all day (?err day) isn?t great for a body. Instead, choose nutrient-dense foods from all food groups, says Cassetty. Good options include whole grains like whole wheat pasta, fruits and vegetables, nuts, and lean protein.
  • Eat more frequently. And never skip meals! It?s easy to feel full fast when you start introducing more calories into each meal; changes in food intake might also bring on gastrointestinal issues and even acne. Make things easier on your belly by spreading calorie intake out over five to six smaller meals throughout the day.
  • Snack dense. Choose calorie-dense snacks like nuts, cheese, dried fruits, yogurt with granola, avocados, and pretzels or whole grain crackers with nut butters or hummus. If leaving the house for a while, pack snacks for calories-on-the-go.
  • Drink calorically. Instead of diet soda and other low-cal drinks, choose filling, high-calorie beverages like smoothies, healthy shakes, or liquid meal replacements. Drink fluids in between meals to add calories and to avoid filling up on beverages during meals (which might make people eat less solid food).
  • Eat before bed. Consider this your permission slip for the midnight munchies. A lot of healing and regeneration happens while we sleep, so eating before bed can give your body the nutrients it needs to do the work. Nom down on a PB & J or a wrap with avocado, vegetables, and lean meat or cheese.
  • Set attainable goals. And remember to be patient. Just like weight loss, weight gain is a process ? and often a slow one, Cassetty says. Gaining might take years, so don?t give up hope if you don?t pack on immediate pounds. The rate at which a person needs to gain weight depends on their health goals and current health status, and a physician or nutritionist can help establish a reasonable goal weight. Signs of reaching an ideal weight include increased energy, stabilized hunger patterns, and overall good health.
  • Get support. It?s important to have a strong support system throughout the process of gaining weight, Cassetty says ? both to help gainers achieve their goals and to cope with the emotional issues that might arise from bodily changes. One of the best ways to adjust to changing size is to spend time noticing and appreciating how your ?new? body appears in the mirror, says Greatist Expert and psychologist Ellen Langer.
  • Dress nice. Don?t put off feeling good about your appearance. Talk nicely to yourself and choose outfits that make you feel good, no matter what you weigh.

Claim: A new advertisement endorsed by Republican presidential nominee Mitt Romney that is airing on KLAS-TV Channel 8 states: "Who will raise taxes on the middle class? Barack Obama and the liberals already have. To pay for government-run health care you'll pay higher taxes and more for your medicine. And their plan includes a trillion dollars in higher taxes, even on the middle class."

Verdict: Partly true and partly misleading. The ad relies on a July 24 report from the politically neutral Congressional Budget Office that analyzed the financial impacts of the June 28 U.S. Supreme Court ruling that upheld the constitutionality of the Affordable Care Act (ACA) backed by President Barack Obama and fellow Democrats in Congress. The Supreme Court ruled that the law that requires most individuals to obtain health insurance or pay a penalty represents a legitimate example of the power of Congress to levy taxes. The CBO estimated that the insurance coverage portion of the law would result in a net cost of more than $1.1 trillion from this year through 2022.

What the ad fails to mention, though, is the CBO's conclusion that these costs "do not encompass all of the budgetary impacts of the ACA because that legislation has many other provisions, including some that will cause significant reductions in Medicare spending and others that will generate added tax revenues, relative to what would have occurred under prior law." More specifically, the CBO estimated that repealing the health insurance law would increase federal budget deficits by $109 billion through 2022. The CBO stated: "Repealing the coverage provisions discussed in this report would save $1,171 billion over that period, but repealing the rest of the act would increase direct spending and reduce revenues by a total of $1,280 billion."

Health Canada's fast-tracked drug approvals can put public at risk, experts say

ScienceDaily (Oct. 8, 2012) ? Drugs streamed into Health Canada's accelerated review process are more likely to be withdrawn from the market or earn a serious safety warning than those that undergo the standard review, according to a recent paper out of York University.

The study, published online by the Archives of Internal Medicine on Oct. 8, is the first of its kind undertaken in Canada. It tracked a total of 434 new active substances (NASs) approved by Health Canada between 1995 and 2010, examining how many subsequently acquired either serious safety warnings or had to be withdrawn from the market for safety reasons. The NASs were then compared to see whether a difference in safety existed between those that had gone through Health Canada's standard 300 day review period vs. the 180 day priority process.

"I found that drugs that went through the standard process had a 1 in 5 chance of either having a serious safety warning issued or being withdrawn from the market for being unsafe," says study author Dr. Joel Lexchin, Professor in York's Faculty of Health. "However, if the drug goes through the priority process, it has a greater than 1 in 3 chance of having the same outcome."

Though some drugs are moved into the priority process because they provide major therapeutic advances for serious illnesses, such as cancer, HIV/AIDS, and multiple sclerosis, and thus may be put through with a lower benefit to harm safety ratio, Lexchin found that the types of drugs in the priority category, and the types of diseases they treated, did not account for the difference in safety issues.

"Even drugs that provided no major therapeutic advances were still more likely to acquire serious safety issues if they were put through the priority review," says Lexchin. "This indicates that the difference is likely due to the faster review missing serious safety issues."

The study concludes that new products that offer major therapeutic advantages should be embraced, even with the significant gaps that exist about their safety, but because most NASs do not fall into this category, clinicians and patients should be using these drugs very cautiously.

Language learning makes the brain grow, Swedish study suggests

ScienceDaily (Oct. 8, 2012) ? At the Swedish Armed Forces Interpreter Academy, young recruits learn a new language at a very fast pace. By measuring their brains before and after the language training, a group of researchers has had an almost unique opportunity to observe what happens to the brain when we learn a new language in a short period of time.

At the Swedish Armed Forces Interpreter Academy in the city of Uppsala, young people with a flair for languages go from having no knowledge of a language such as Arabic, Russian or Dari to speaking it fluently in the space of 13 months. From morning to evening, weekdays and weekends, the recruits study at a pace unlike on any other language course.

As a control group, the researchers used medicine and cognitive science students at Ume? University -- students who also study hard, but not languages. Both groups were given MRI scans before and after a three-month period of intensive study. While the brain structure of the control group remained unchanged, specific parts of the brain of the language students grew. The parts that developed in size were the hippocampus, a deep-lying brain structure that is involved in learning new material and spatial navigation, and three areas in the cerebral cortex.

"We were surprised that different parts of the brain developed to different degrees depending on how well the students performed and how much effort they had had to put in to keep up with the course," says Johan M?rtensson, a researcher in psychology at Lund University, Sweden.

Students with greater growth in the hippocampus and areas of the cerebral cortex related to language learning (superior temporal gyrus) had better language skills than the other students. In students who had to put more effort into their learning, greater growth was seen in an area of the motor region of the cerebral cortex (middle frontal gyrus). The areas of the brain in which the changes take place are thus linked to how easy one finds it to learn a language and development varies according to performance.

Previous research from other groups has indicated that Alzheimer's disease has a later onset in bilingual or multilingual groups.

"Even if we cannot compare three months of intensive language study with a lifetime of being bilingual, there is a lot to suggest that learning languages is a good way to keep the brain in shape," says Johan M?rtensson.

We Love Fall...We Love Halloween!!

This is the second year in a row...that we moved right during fall...putting a serious crunch on all the Fall activities!

In a desperate attempt to get our new home feeling like FALL...we have had a slight EXPLOSION OF PUMPKINS!

I gave the kids all a paper...and orange paint..

Motel explosion shatters windows, injures no one

ANAHEIM ? An explosion about 1 a.m. Sunday at the Rainbow Inn, 831 S. Beach Blvd., led to the evacuation of motel residents, police said.

Police, firefighters and the Orange County Bomb Squad investigated the explosion that shattered the windows of three motel rooms, Sgt. Wayne Alonso said.

An explosion at the Rainbow Inn on Beach Boulevard in Anaheim early Sunday morning left a couple units with blown out windows and around 100 people evacuated from the Rainbow Inn and two surrounding motels while the Orange County Sheriff Bomb Squad and Anaheim Fire & Rescue Hazmat team investigated the cause of the explosion.

No one was injured, authorities said.

Police said the cause and origin of the explosion could not be immediately determined.

"Whether it came from outside or inside no one knows," Alonso said.

Police closed South Beach Boulevard in front of the motel during the investigation, Alonso said.

About 3 a.m., a driver attempted to maneuver around police vehicles at Beach and Ball Road, authorities said.

Brian Kim, 25 from Garden Grove, struck a police car and was arrested on suspicion of drunken driving. Neither he nor police were injured, Alonso said.

The only thing that will cost you a fee is their personalized portfolio management that starts at 0.95% of managed assets and goes down from there depending on how large the assets you are letting them manage are. (This is inline with the industry, and for the most part below what wealth managers would charge.)

Investing expenses and taxes are the two things you can absolutely count on within the investing world. You can?t rely on gains every year, but you can guarantee you will be taxed and you will pay expenses. That makes reducing those expenses as one of two ways you can control your investing destiny.
